Know the complete process of registry, must check these documents

Whenever we buy a property, such as a plot, flat or duplex, it is most important to get it registered. Registry is the process of registration in government documents that gives legal validity to your property. It is necessary to take several precautions before purchasing and registering the property so that no disputes arise in the future. For this, it is necessary that before purchasing the property, the answers to all the questions related to it should be clear. All the documents related to it should be original and in accordance with the rules and regulations of the government. If you are taking a plot or flat, then a lot of trouble can be avoided by taking care of few things before the registry. After checking the documents and being fully satisfied with the answers to the questions, the further process for purchasing the property should be initiated. When everything is clear, the registry should be done by depositing the stamp duty. In this, the conditions, time limit, prices are mentioned with the consent of both the parties.

Check these 6 documents before registering the property:

1. Sale Deed: It is a legal document in which the seller of the property transfers all the rights related to the property to the buyer.

2. Encumbrance Certificate: From this, you can check whether the property you are taking is not owed any loan or is not in a legal case.

3. Title Deed: This shows whether the title of the property is in the name of the person from whom you are going to buy the land.

4. Gift deed: Gift deed is the transfer of property to a close relative without taking anything in return.

5. Lease:Taking the property by giving a fixed amount for a fixed period of time is called Patta or Lease.

6. Khasra Bahi:Khasra number is the survey number of a property. This is the land number of the rural area.

Answers to these questions must be taken from the sub-registrar and Tehsil office:

• Is the property government or private?
• Is there a right to sell the property or not?
• Whether the person is the actual owner or not?
• Is there any restriction by the government?
• Is the property illegal or legal?

Complete process of registry

Make a draft of the registry

Get the registry drafted through a trusted advocate. It contains details related to seller and buyer, sale price, ownership of the property and the terms and conditions of both the parties.

Collect the necessary documents

Original Registry of the property, Khasra Bahi, mutation, three photographs from different angles of the property, map, original Aadhaar card of seller and buyer, PAN card or any other ID proof, two witnesses and their original Aadhaar card are required.

Payment of Stamp Duty

Necessary documents, Registry, ID, photo and map etc. are uploaded in Sampada software. Through Sampada software itself, the buyer books the slot by paying the stamp duty prescribed by the government online

Date of Registry in Sub Registrar’s office

On the appointed date and time, the buyer, seller and witness have to reach the Sub Registrar's office with their original ID and original documents of the property. Here everyone's digital signature, thumb impression and photo are taken.

Registration of Registry

The documents of the registry and the stamp duty deposited are scrutinized by the sub-registrar. Registration is done when everything is done according to the rules.
